This document is an official proposal (public offer) by A. V. Agibalov, a self-employed individual (payer of the professional income tax, INN 784000182598; hereinafter the "Contractor"), to conclude an agreement for the provision of the services of Luviomic on the terms set out below with any individual or legal entity (hereinafter the "User").
2.1. The Contractor provides the User with access to the Service for converting speech to text, processing it (cleanup, tone selection, translation) and other related functions under the terms of the selected plan.
2.2. The scope and composition of the services are determined by the selected plan or minute package described on the Service website in the "Pricing" section.
2.3. The Contractor may provide the User with a trial (free) volume of services (trial).
3.1. Acceptance (full and unconditional acceptance of the terms) is the performance by the User of any of the following actions: registering with the Service, using the trial volume, or paying for the services.
3.2. From the moment of acceptance, the agreement is deemed concluded. The User confirms that they have read and agree to this offer, the Privacy Policy and the Refund Policy.
4.1. The cost of the services is indicated on the Service website and in the app: for Users outside the Russian Federation — in US dollars (USD), and for eurozone countries — in euros (EUR); for Users in the Russian Federation — in Russian rubles. The currency and payment method are determined automatically by the interface language and the User's country (based on the IP address); the amount and currency are shown to the User before payment. The minimum one-time top-up of minutes paid in USD or EUR is USD 5 or EUR 5 respectively. VAT is not charged: the Contractor applies the special tax regime "Professional Income Tax" (self-employed).
4.2. Payments in US dollars and euros are accepted through the lava.top platform. Payment is made by bank card and by other methods available on the lava.top checkout page. If the currency of your card differs from the payment currency, the conversion is performed by your bank at its own rates.
4.3. Payments in Russian rubles are accepted through the payment service YooKassa (YooMoney LLC). Payment is made by bank card (Visa, Mastercard, Mir), via the Faster Payments System (SBP) and by other methods available in the YooKassa interface.
4.4. Payment card details are entered on the secure page of the payment service (lava.top or YooKassa) and are not transferred to the Contractor.
4.5. The moment of payment is the moment the funds are received in the payment service's account. After the payment is confirmed, the corresponding volume of minutes is credited to the User's balance, and when a subscription is purchased, the pricing plan is activated.
4.6. Upon settlement, the Contractor generates and sends the User a receipt in the manner established by Federal Law No. 422-FZ (via the "My Tax" app).
4.7. The Contractor may change prices; new prices do not apply to periods that have already been paid for.
6.1. Personal data is processed in accordance with the Privacy Policy and Russian Federal Law No. 152-FZ "On Personal Data."
6.2. Voice audio recordings are processed to the extent necessary to provide the service and are not stored by the Contractor after the result has been generated.
7.1. The Service is provided "as is." The Contractor does not guarantee absolute accuracy of speech recognition and processing.
7.2. The Contractor is not liable for the consequences of the User's use of the generated text, nor for interruptions in operation caused by circumstances beyond its control (failures of providers or networks, force majeure).
7.3. The Contractor's aggregate liability is limited to the amount actually paid by the User for the period in which the grounds for liability arose.
8.1. The terms and procedure for refunds are set out in the Refund Policy, which is an integral part of this offer.
9.1. The agreement is effective from the moment of acceptance until the parties have fully performed their obligations.
9.2. The User may stop using the Service at any time and delete their account in the Account Dashboard.
9.3. Disputes are resolved through negotiation and, if no agreement is reached, in accordance with the legislation of the Russian Federation at the Contractor's location.
